Daniel L. Schmidt Arrested, Charged with Two Counts of First-Degree Intentional Homicide
MADISON — Attorney General J.B. Van Hollen announced today that a Shawano man has been charged with two counts of First-Degree Intentional Homicide in the May 2009 deaths of Kimberly Rose and Leonard Marsh in the Town of Gillett in Oconto County.
The criminal complaint, issued September 5, 2012, alleges Daniel L. Schmidt, 29, intentionally caused the deaths of Kimberly Rose and Leonard Marsh in Rose's Town of Gillett home in May 2009.
Schmidt made an initial appearance this afternoon in Oconto County Circuit Court before the Honorable Judge Jay Conley, who set bail at $2 million. An adjourned initial appearance is scheduled for September 26, 2012, at 2 p.m.
The matter was investigated by the Oconto County Sheriff's Department and the Wisconsin Department of Justice -- Division of Criminal Investigation (DCI). Assistant Attorney General David J. Wambach is acting as Special Prosecutor in the case.
A defendant enjoys the presumption of innocence. The charges found in the criminal complaint are merely allegations until and unless the prosecution proves its allegations at trial beyond a reasonable doubt.
