Colonial View Apartment Owner Fined $6,155 for Failing to Monitor Water System

KENOSHA – Attorney General J.B. Van Hollen announces that his office has obtained a judgment against Jerry L. Wanty in Kenosha County, the owner and operator of the Colonial View Apartments at 337-339 Holy Hill Road, Town of Randall, Kenosha County. Mr. Wanty owns and operates the apartments, including a community water system serving at least 25 people living in 16 apartments.

Wisconsin law requires Mr. Wanty to routinely monitor and sample the water to guarantee that it meets clean drinking water standards. The Department of Justice filed a civil complaint alleging numerous violations of Wisconsin law on August 9, 2010. The complaint alleges that Mr.Wanty failed to monitor the system for coliform bacteria, organic chemical contaminants including sodium, arsenic and nitrate, synthetic organic contaminants and volatile organic compounds including lead and copper. The State filed a motion for summary judgment before the Honorable Bruce E. Schroeder. After two evidentiary hearings the Court ordered defendant Wanty to pay $6,155.50 in forfeitures and penalties. Assistant Attorney General Cynthia R. Hirsch prosecuted the case.
