MADISON – Attorney General J.B. Van Hollen announces that his office has joined a settlement in federal court between City of Menasha, Menasha Utilities, and the Sierra Club. The consent decree lodged in the United States District Court Eastern District of Wisconsin was signed into final judgment by the Honorable William C. Griesbach on February 15, 2011.
The City of Menasha and Menasha Utilities were investigated by DNR for violations of their air pollution permits. The consent decree requires defendants City of Menasha and Menasha Utilities to cease operation of the boilers at the utility and insure that no combustion occurs within and no air emissions are created from combustion of coal, petroleum coke, or tire derived fuels in the boilers of the River Street plant.
Assistant Attorney General CynthiaR.Hirsch prosecuted the case.
