MADISON – Attorney General J.B. Van Hollen announces today that his office has successfully obtained summary judgment against a Waukesha County developer, Country West Development, LLC, in Waukesha County Circuit Court.
The Department of Justice filed a civil complaint against Country West Development in August 2009 alleging failure to implement and maintain erosion control measures and discharging pollutants into a nearby wetland and brook, in violation of Wisconsin pollution laws. The violations relate to a 67.4-acre residential real estate project known as Field Crossings located in the Town of Genesee, Waukesha County. On April 18, 2011, the Court ordered Country West Development to pay total forfeitures and statutory penalties of $49,447 within 30 days.
The case was investigated by the Department of Natural Resources and was prosecuted by Assistant Attorney General Cynthia R. Hirsch. The case was heard by Waukesha County Circuit Court Judge Ralph M. Ramirez.
