MADISON - Attorney General J.B. Van Hollen announced that Larry Presby was sentenced on March 11, 2010 by Marinette County Circuit Court Judge Tim A. Duket for repeated sexual assaults of a child. Judge Duket imposed a 35 year prison sentence consisting of 25 years initial confinement and 10 years extended supervision.
On January 15, 2010, an Oconto County jury convicted Larry Presby of repeated acts of sexual assault after a 5 day trial.
In 2005, Presby was convicted of first degree sexual assault of a child and sentenced to over 13 years in prison. The case was previously prosecuted by the Oconto County District Attorneys office, but the Wisconsin Department of Justice was appointed as Special Prosecutor after a mistrial.
The single count of repeated acts of sexual assault is a Class B Felony and carries a term of imprisonment not to exceed sixty (60) years. The sentence that Judge Duket imposed is consecutive to the previous 13 year sentence. Presby will be eligible for release on extended supervision on January 1, 2043.
This case was prosecuted by Assistant Attorney General Dennis Krueger and was investigated by the Wisconsin Department of Justice's Division of Criminal Investigation.
